Title: Housing Company Takes Action Against Tenant
Date: 29/04/08
Court action has been taken by The Gateshead Housing Company against a tenant convicted of drug-related offences.
Lynn Napier, 35, of Reasby Gardens, Ryton, agreed a one-year postponed possession order following her conviction for possession of cannabis with intent to supply.
Gateshead County Court granted the order after hearing that Napier had breached her tenancy agreement for a second time by not paying her rent.
Napier’s conviction at Newcastle Crown Court came after a police raid at her home uncovered a significant amount of cannabis.
Following her conviction Napier was given a two-month prison sentence suspended for two years, with supervision for two years and 100 hours unpaid work.
The postponed possession order, which will run until February 2009, prohibits Napier from doing anything that breaches her tenancy agreement.
The order states possession will be sought if ‘rent lawfully due from the tenant has not been paid’.
The order also states that Napier must ensure that her home must not be allowed to deteriorate owing to her own neglect, or that of anyone living with her.
The postponed possession means that if any further incidents occur between now and February 2009, the housing company can seek a permanent eviction from the property.
Bill Fullen, Chief Executive of The Gateshead Housing Company is pleased to be working with Gateshead Council, the police and the courts to reduce anti-social behaviour, and has vowed to keep on doing so.
He said: “The Gateshead Housing Company wants to give local people the homes they deserve, through our £1m a week programme of major improvements.
“But it also wants to help people feel safe in their homes and neighbourhoods, whatever their age, race or background.
“Tenants and leaseholders have told us previously that dealing with anti-social behaviour on estates is their number one priority.
“We intend to carry on making sure that the small minority of tenants who cause such misery, nuisance and annoyance to local people are dealt with severely, and show that there is no place for anti-social behaviour in Gateshead.”
In the past year, The Gateshead Housing Company’s Neighbourhood Relations Team has worked to get several anti-social tenants evicted, and also gained suspended eviction orders and Anti-Social Behaviour Orders (ASBOs) against a number of residents across the borough.
The company has a number of other cases pending, which could result in further action against anti-social tenants and their families.
